Tampa, Florida -- Defense attorneys for the doctor's son who slipped his girlfriend the abortion pill causing her to miscarry now want to argue the pill, he admits to giving her, did not have enough dosage to cause the miscarriage.

At a hearing Thursday in court, prosecutors said if the defense gets to argue the pill drug level did not kill baby, defense lawyers will have violated John Welden's plea agreement.

Prosecutors could look into reinstating more serious charges and go to trial.

Welden admitted in court he forged his father's signature to get the abortion drug prescription.

His ex-girlfriend Remee Lee lost the embyro at seven weeks.
